U Tutors LLC, doing business as U Tutors Academy. 5915 Ponce de Leon Blvd, Suite 18, Coral Gables, FL 33146 · 786-730-6332 · ututors@ututorsacademy.com
Version 2026-10-28 · Effective October 28, 2026 · Published at us.ututorsacademy.com/terms
1. What these Website Terms cover
These Website Terms of Use and Tutoring Terms (“Website Terms”) govern (a) your use of the website at us.ututorsacademy.com and its forms (the “Site”) and (b) the one-on-one tutoring and test-preparation services, including the free consultation, that U Tutors LLC, doing business as U Tutors Academy (“U Tutors”, “we”, “us”), provides at 5915 Ponce de Leon Blvd, Suite 18, Coral Gables, Florida 33146 and, where agreed in writing, online (the “Services”). Camps are offered under separate registration terms and are not part of the Services.
In these Website Terms, the “Client” is the parent, legal guardian or adult student who enrolls; a “Student” is each person who receives tutoring; the “Client Terms” are our Client Terms and Conditions (us.ututorsacademy.com/client-terms) and our Privacy Policy for Tutoring Clients (us.ututorsacademy.com/client-privacy), accepted at checkout; the “Client Services Agreement” is the agreement each Client signs before the free consultation; and the “Portal Terms” are the terms accepted when opening an account on our TutorCruncher tutoring portal.
By using the Site you agree to Sections 2 through 5 and 12 through 18. Sections 6 through 11 summarize the tutoring terms; the signed Client Services Agreement and the Client Terms control if there is any difference. The online practice platform at practice.ututorsacademy.com has its own Terms of Service, Privacy Notice and Children’s Privacy Notice, which govern that product.
2. Using the Site
The Site is for parents, legal guardians and adult students. It is not directed to children under 13, and we do not knowingly collect personal information from children through the Site. When a parent fills in our request form, the parent gives the student’s first name and grade so we can prepare the free consultation. A student in grade 7 or below is asked to have a parent fill in the form instead. When a form shows that a student filled it in, no advertising tag records the request and nothing about it is sent to Google or Meta. If we learn that a child under 13 has sent us information through the Site, we delete it.
You agree to give accurate contact details on our forms and not to use the Site to send spam, scrape content, test security, or impersonate anyone.
How we contact you. When you send a form or leave us a message, you are asking us to contact you about your request. We may call, text or email you about it at the number and address you give. We send marketing texts or calls using an automated system only to people who give the optional consent on our form or in the Client Services Agreement, and that consent is never a condition of any purchase. Reply STOP to any text to stop texts. We make these calls only between 8 a.m. and 8 p.m. your local time. Sending a form is a use of the Site, so these Website Terms, including the arbitration agreement in Section 14, apply to your request and to our calls, texts and emails about it.
The Site’s content (text, photos, the spacing-effect calculator, logos and the U Tutors name and “μ” mark) belongs to U Tutors or its licensors. You may view it for personal, non-commercial use. Do not copy, republish or use it commercially without our written permission.
We may change the Site or these Website Terms at any time; the version date at the top changes with them. Changes to the tutoring terms reach enrolled families as described in the Client Terms and the Client Services Agreement.
3. Free consultation and how enrollment works
The free consultation is one session at no cost and no obligation. Before it, the Client signs the Client Services Agreement (electronically or at the center); that Agreement covers the consultation and any tutoring that follows. The consultation does not take place until the Agreement is signed, and the Site says so wherever the consultation is offered.
After the consultation we quote, in writing, an hourly rate for the Student’s subject and instructor level.
Paid tutoring begins after the Client opens a portal account on TutorCruncher (accepting the Portal Terms) and, at checkout, accepts the Client Terms, saves a credit or debit card, and pays for any package being bought. Clients paying with scholarship funds also save a card, which is charged only as Section 9 allows.
Nothing on the Site is an offer that binds either side until these steps are complete.
4. Links to other services
The Site links to our tutoring portal (app.tutorcruncher.com), our online practice platform (practice.ututorsacademy.com), the Step Up For Students EMA marketplace, Google Maps, Instagram, Facebook and the Better Business Bureau. Each is run by its owner under its own terms and privacy practices, and we are not responsible for their content or practices.
Coral Gables Psychological Services is an independent psychology practice. It is not part of U Tutors, and U Tutors does not provide psychological evaluations, counseling or therapy. The free consultation the practice offers is its own service, provided on its own terms. If you ask about it, we give you the practice’s public phone number and website and you contact it directly; we do not book consultations for the practice or send it your information. Neither business is obliged to refer anyone to the other, and neither pays or receives anything, in money or in kind, for referrals in either direction. We share a Student’s records with the practice only with the parent’s written permission for that specific disclosure.
Badges. The Better Business Bureau seal appears on the Site only while U Tutors is BBB-accredited. The Step Up For Students badge shows that U Tutors is a provider on the EMA marketplace. Neither organization endorses our tutoring.

GRE® and TOEFL® are registered trademarks of ETS. GMAT® is a registered trademark of the Graduate Management Admission Council. MCAT® is a registered trademark of the Association of American Medical Colleges. DAT® is a trademark of the American Dental Association. OAT® is a trademark of the Association of Schools and Colleges of Optometry. The University of Miami name belongs to the University of Miami. Our center is in the Plumer Building on the University of Miami’s Coral Gables campus, but U Tutors Academy is an independent business and is not part of, affiliated with or endorsed by the University of Miami. None of these organizations is affiliated with, sponsors or endorses U Tutors, the Site, our tutoring or our practice materials, and we use their names only to describe the exams we prepare students for and where our center is located. Our practice questions are our own and are not official test questions; practice results are not official scores.
6. Tutoring Terms: rates, packages and payment
Tutoring is priced by the hour, from $85.00 per hour. The exact rate depends on the subject and the instructor’s level (university freshman or sophomore, junior or senior, graduate student, PhD candidate, school teacher, university professor) and is quoted in writing after the consultation; the quote states the level of the instructor assigned. There is no membership or sign-up fee.
Hour packages are paid in full at checkout and discount every hour in the package: 10 hours at 10% off, 15 hours at 15% off, 20 hours at 20% off the quoted rate.
Hourly (non-package) sessions are invoiced after they occur and are due within fourteen (14) days of the invoice date.
Rates may change on fifteen (15) days’ written notice. A rate change does not affect hours already paid for.
A check, debit card payment or electronic funds transfer that is returned or dishonored incurs the service charge allowed by Fla. Stat. § 68.065 ($25 if the payment is $50 or less; $30 if it is more than $50 and not more than $300; $40 if it is more than $300; or 5% of the payment, whichever is greater).
Instructor travel and preparation time are not billed.
7. Tutoring Terms: scheduling, cancellation and no-shows
Sessions are scheduled with the instructor through the TutorCruncher portal. U Tutors tracks every session.
To cancel or reschedule without charge, give written notice (portal, email or text to 786-730-6332) at least twenty-four (24) hours before the session starts.
A session cancelled with less than 24 hours’ notice, or missed, is charged at the full session rate, or the session’s hours are deducted from the package. If we fill the slot with another student, the charge is reversed within fourteen (14) days: the package hours are restored (with their original expiry) or the hourly charge is refunded to the original payment method.
If U Tutors or the instructor cancels, no charge applies and the session is rescheduled at a mutually convenient time.
Sessions start and end at the scheduled time; a late arrival shortens the session.
8. Tutoring Terms: refunds, expiry and the right to cancel
Right to cancel. U Tutors gives every Client the right to cancel without penalty within three (3) business days after the later of the Client’s first acceptance of the Client Terms at checkout or first signature on the Client Services Agreement. We refund all payments within thirty (30) days after receiving the notice, except the hourly rate for any paid session delivered at the Client’s request before the notice; amounts paid with scholarship funds are returned to the scholarship account or as the SFO directs. The Client Terms and the Client Services Agreement explain how to cancel.
Package refunds. A package may be refunded within thirty (30) days of purchase. The refund equals the amount paid for the package minus the hours already used, with used hours valued at the undiscounted hourly rate in effect when the package was bought (the discount was given for buying the whole block). Example: a 10-hour package at a $100 rate costs $900; after 3 hours, the refund is $900 − (3 × $100) = $600. If the result is zero or less, no refund is due and nothing more is charged. Refunds are paid within thirty (30) days of the written request, to the original payment method. After thirty (30) days from purchase, a package is not refundable except as stated in this Section or as the law requires.
Expiry. Unused package hours expire twelve (12) months after purchase.
Hourly sessions are not refundable once delivered.
If U Tutors ends the relationship for its own reasons, unused package hours are refunded pro rata at the discounted package rate within thirty (30) days. No refund is owed if we end it for cause: non-payment; an academic-integrity violation or a request for one; harassment, threats, discrimination, damage to property or other abusive or unsafe conduct by the Client or Student; false enrollment details or an unauthorized payment method; or a breach of the Client Terms or the Client Services Agreement.
Medical inability or discontinued service. If the Student becomes physically unable to continue on a doctor’s written order, or U Tutors stops offering the contracted service, unused package hours are refunded pro rata at the discounted package rate within thirty (30) days.
Referral credit. A $150 credit is applied to the referring Client’s account after the referred family’s first paid session. It can be used only for tutoring sessions at the center, has no cash value, is not refundable, and is reversed if the referred family’s first paid session is refunded. Referral credits are not offered to Clients whose sessions are paid in whole or part with scholarship funds (Section 9).
9. Tutoring Terms: Step Up For Students and other scholarship funds
U Tutors is a provider on the Step Up For Students Education Market Assistant (EMA) marketplace. If a Client pays with a Florida scholarship account administered by a Scholarship Funding Organization (SFO), for example the Family Empowerment Scholarship for Unique Abilities, the Personalized Education Program, the Florida Tax Credit Scholarship or a New Worlds Scholarship Account:
Scholarship-funded sessions are taught only by instructors whose credential qualifies for the subject taught under Fla. Stat. § 1002.394 or § 1002.395 or, for a New Worlds Scholarship Account, § 1002.411, and who are listed with U Tutors in EMA. U Tutors bills scholarship funds only for sessions already delivered: it invoices EMA after each session, naming the instructor, date and hours.
A Client who plans to pay U Tutors directly and then ask the SFO for reimbursement must tell U Tutors in writing before booking. Those sessions are then handled as scholarship-funded sessions under this Section, except that the Client pays U Tutors, and U Tutors’ receipts show what the Client paid and the sessions delivered (instructor, date and hours). Whether and when the SFO reimburses the Client is between the Client and the SFO, and the Client remains responsible for paying U Tutors.
Packages, deposits, sessions with a non-qualifying instructor, and late-cancellation and no-show charges are never invoiced to a scholarship account; they are private-pay charges. Scholarship-funded sessions are billed at the quoted hourly rate, without package discounts.
Switching to scholarship funds. If a Client with unused package hours starts paying with scholarship funds, the remaining package hours stay private-pay at the package rate and are used before or alongside scholarship-funded sessions as the Client directs, until they are used or expire. Package hours are never transferred to, credited to or invoiced to a scholarship account, and no package refund is made because scholarship funding began.
The Client must approve each valid EMA invoice within seven (7) days of submission. If an invoice is not approved in time, is denied or reversed, or exceeds the scholarship balance, the amount becomes the Client’s private-pay responsibility at the rate that applies to that session and is charged to the card on file.
When U Tutors accepts an SFO payment as full payment for a session, it does not bill the Client the difference between its rate and the SFO-authorized rate. Separately contracted private services are billed to the Client.
U Tutors never pays, rebates or credits scholarship funds to a Client. Any refund or credit of an amount paid with scholarship funds, including an amount the Client paid and the SFO reimbursed, is returned to Step Up For Students for deposit into the Student’s scholarship account (or as the SFO directs if the account is closed), and a duplicate SFO payment is returned to the SFO.
Referral credits, promotional credits and gifts are not offered to Clients whose sessions are paid in whole or part with scholarship funds, and the free consultation is never invoiced to a scholarship account.
U Tutors will never ask for or use a Client’s EMA username or password.
10. Tutoring Terms: what we provide and what we do not
Every in-person tutoring session is one instructor and one Student in a private cubicle. Instructors are selected and assigned by U Tutors; we may change the assigned instructor and will tell you when we do.
We provide academic instruction only. U Tutors is not a licensed child care facility: we provide no child care, custody, transportation or supervision outside the scheduled session, and no medical, psychological or counseling services. Arrival and departure arrangements for minors are set in the Pickup Authorization in the Client Services Agreement, and a Student under twelve (12) may be at the center without a parent on the premises only for the scheduled session, under an arrangement U Tutors has approved in writing.
We do not guarantee any grade, score, admission, scholarship or other result. Practice results and score estimates are for study only.
Instructors tutor, explain and coach. They do not complete assignments, write essays, take exams or supply answers for a Student to submit as their own. If asked to, U Tutors may end the engagement for cause, without refund.
U Tutors does not use companion or emotional-support chatbots with Students, does not perform behavioral or psychological assessments, and has no duty to monitor a Student’s emotional wellbeing, other than reporting suspected child abuse, abandonment or neglect to the Florida Abuse Hotline, as Fla. Stat. § 39.201 requires.
Clients sign a release of liability for ordinary risks at the center, and, where the Student is a minor, a parent also signs a separate waiver of inherent risks under Fla. Stat. § 744.301(3) (Client Services Agreement Sections 10 and 11). If a Client privately engages an instructor met through U Tutors during the engagement or within twelve (12) months after it ends, a placement fee applies (Client Services Agreement Section 7).
11. Tutoring Terms: cameras and audio recording
The center’s security cameras record video only, with no audio, at all times, in common areas and study cubicles, for the security of the premises. Posted signs state that a video surveillance system has been installed for the purpose of security for the premises. No camera is placed in a restroom or anywhere a person may change clothes. Security video is viewed only by U Tutors management, to look into a safety incident or complaint or when the law requires; it is never used in marketing and is kept for ninety (90) days, longer only if an incident is flagged for review.
Audio recording of a tutoring session happens only if the Client opts in by signing the Audio Recording Consent (Client Services Agreement Section 13), with the prior consent of the Client (and of an adult Student personally), the instructor and, at the start of each session, the Student, and, for a Student under 13, only after the parent’s consent is verified under Section B.8 of the Privacy Policy for Tutoring Clients. Audio recordings exist so the parent can hear how tutoring is being done. They are shared only with the Client and the instructor; U Tutors staff access a recording only to deliver or delete it or to investigate a complaint, and do not use recordings to evaluate instructors. They are not transcribed or analyzed by software or artificial-intelligence tools, are never used in marketing, and are deleted sixty (60) days after the session, or sooner on request, unless needed to investigate a complaint or legal claim, in which case they are kept until it is resolved.
U Tutors does not video-record, screen-record or capture online sessions. An online session is audio-recorded only under the same opt-in and rules as a session at the center.
12. Privacy
Our website Privacy Notice at us.ututorsacademy.com/privacy explains what the Site collects, which service providers process it, how long we keep it and how to ask us to delete it. Our Privacy Policy for Tutoring Clients (us.ututorsacademy.com/client-privacy) explains what we collect to provide tutoring; its Section B.8, our Children’s Privacy Notice for the online tools used in tutoring, is at us.ututorsacademy.com/children-privacy. The practice platform has its own privacy notices.
13. Disclaimer and limitation of liability
To the extent the law allows, the Site and its content are provided “as is” without warranties of any kind. U Tutors is not liable for indirect, incidental, special, consequential or punitive damages arising from the Site or the Services, including a denied admission, a lost scholarship, the cost of other tutoring or lost data. Our total liability for all claims arising from the Site or the Services is limited to the greater of the fees paid to us in the twelve (12) months before the claim arose or $100. The exclusion and the limit in this Section do not apply to any claim arising from a minor Student’s injury, death or property damage, whoever brings it, or to liability for gross negligence, intentional misconduct or anything else that cannot be limited under Florida law.
14. Disputes
Before starting arbitration or a small-claims case, either side sends the other a written notice describing the dispute (to U Tutors at the address at the top of this page or ututors@ututorsacademy.com; to a Client at the account email), and both try in good faith to resolve it within thirty (30) days.
If it is not resolved, any dispute arising out of or relating to the Site, these Website Terms, the Services, billing, or calls, texts or emails from U Tutors is decided by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules and the Federal Arbitration Act, in Miami-Dade County, Florida, except that (a) either side may bring an individual claim in small-claims court; (b) U Tutors may ask a court to stop misuse of its content; and (c) the arbitration agreement and the class, collective and representative-action waiver in this Section do not apply to a sexual harassment or sexual assault dispute that the person bringing it elects to bring in court under 9 U.S.C. §§ 401–402.
Claims may be brought only individually, not as a plaintiff or class member in any class, collective or representative proceeding. If a claim goes to court instead of arbitration, both sides waive a jury trial to the extent the law allows.
The prevailing party in any arbitration or court case allowed by this Section may recover reasonable attorney’s fees and costs.
These Website Terms are governed by Florida law and the Federal Arbitration Act. Any court case allowed by this Section is heard in Miami-Dade County, Florida, and each side consents to personal jurisdiction there. For enrolled families, the dispute terms in the Client Terms and the Client Services Agreement, which are the same in substance, control.
15. Force majeure
U Tutors is not in default for a failure or delay caused by events beyond its reasonable control, including hurricanes, tropical storms, flooding, utility or internet outages, cyber-attacks, government orders, and outages of third-party platforms (TutorCruncher, Stripe, EMA, cloud hosting). Affected in-person sessions are moved online or rescheduled without penalty.
16. Reviews, testimonials and advertising claims
Reviews. We ask families for reviews in the same way whether their experience was good or bad. We never offer money, discounts, credits, gifts or anything else of value for a review, and we never try to stop, hide or remove a review because it is negative. We do not ask our owners, managers, staff, instructors or their relatives to review U Tutors, and we require our staff and instructors to disclose their connection to us clearly if they post a review.
Reviews shown on the Site. Where the Site shows reviews from Google or another platform, it shows them as written. If it shows only some of them, it says how they were chosen and links to the full set.
Testimonials. A family’s testimonial describes that family’s own experience and is used only with written permission (Client Services Agreement Section 14). A testimonial about a score or grade gain is used only if it reflects what our students generally achieve, or together with a clear statement of what they generally achieve. A testimonial is not a promise of any result.
Instructor videos. Videos and statements by our instructors are identified as coming from U Tutors instructors, who are paid by U Tutors.
Research. Where the Site describes research on learning and memory, such as the spacing effect, it describes published research in general terms. It is not a promise about any Student.
17. Accessibility
We want everyone, including people with disabilities, to be able to use the Site and our Services. We work to make the Site meet the Web Content Accessibility Guidelines (WCAG) 2.1, Level AA, and we check it regularly. If any part of the Site is hard to use, or you need information from it in another format, contact us at ututors@ututorsacademy.com or 786-730-6332 and tell us the page and the problem. We will respond promptly, give you the information or complete your request another way, and work to fix the problem. If a Student needs an accommodation at the center, tell us before the first session.
18. General
If a part of these Website Terms is unenforceable, it is limited to the minimum extent necessary and the rest stays in force. Our not enforcing a term once does not waive it later. These Website Terms, the Client Terms, the Client Services Agreement and the Portal Terms are the entire agreement about the Site and the Services, and neither side relies on any statement not written in them. These terms are written in English. Any translation is provided for convenience only; if a translation and the English text differ, the English text controls.
