Operator and contact
U Tutors LLC, doing business as U Tutors Academy, 5915 Ponce de Leon Blvd, Suite 18, Coral Gables, FL 33146 · 786-730-6332 · ututors@ututorsacademy.com, is the only operator collecting personal information from children through the tools in this Section. A “child” means a person under thirteen (13).
What we collect online from a child, and why
With a parent’s verified consent we collect: (1) for a student login to our TutorCruncher portal, the email address or username used to sign in, the IP address and device and browser details recorded at sign-in, and anything the child enters or uploads in the portal; (2) through our in-session tablets, the notes and work the child writes, saved under the child’s name; and (3) only if the parent also opts in to audio recording, audio recordings of sessions containing the child’s voice. We use this only to run the login, continue instruction from session to session, deliver recordings to the parent, keep these tools secure and, after removing anything that identifies the child, improve our own teaching. No U Tutors tool lets a child make personal information publicly available. Most of what we hold about a Student comes from the parent, not online from the child, and is described in Sections B.2 to B.4.
Disclosure
We disclose a child’s personal information only to (a) the service providers that process it only for us (TutorCruncher, and the cloud services that store tablet notes and recordings); (b) where required by law, court order or Florida’s child-abuse reporting law, or to protect a child in an emergency; and (c) if U Tutors is sold or merged, the buyer, which takes our place as operator of these tools, must keep this Policy’s promises and must obtain your renewed consent before any new use; we will email you before the transfer.
Consent before collection
We collect, use or disclose a child’s personal information online only after giving the parent direct notice and obtaining verifiable consent. Until consent is verified, including at the free consultation, U Tutors does not create a student login, save tablet notes under the child’s name, or record the session; in-person tutoring continues without these tools.
How we verify consent. After you receive the notice to parents and tick the consent box, we verify that you are the child's parent by a charge to a credit or debit card in your name whose issuer notifies the primary account holder of each transaction (16 C.F.R. § 312.5(b)(2)(ii)). This applies to every Client whose Student is under 13, including Clients who pay for tutoring with scholarship funds, by check or in cash. The verifying charge is your package payment at checkout or, if nothing else is charged to the card at checkout, a \$25 consent deposit charged to the card at checkout. The deposit is refunded in full to the same card, either as soon as the charge is confirmed or when the Student's first session after checkout is completed, as stated at checkout, and in any case within thirty (30) days; the refund does not undo the verification. A saved card that has not been charged, a \$0 or temporary authorization, a gift card or other prepaid card, a bank-account payment, a check, cash or a scholarship (EMA) payment does not verify consent. If the charge is disputed with your card issuer as unauthorized, your child's online tools are turned off until consent is verified again, and if it is not verified within thirty (30) days we delete the information collected online from your child. Until the verifying charge is made, your child's online tools stay off and in-person tutoring continues. After verification we email you (and, where we have your mobile number, text you) a confirmation that restates what you consented to and how to revoke it. We keep a record of each consent: the account, the date and time, the version of the notice, the boxes ticked and the payment transaction
Parental rights
A parent may at any time obtain a description of the types of personal information collected from the child, review it, direct us to delete it, refuse further collection or use, and revoke consent, through the password-protected portal or by writing from the account email (we confirm by calling the phone number on file). We respond within ten (10) business days. A parent may also revoke consent at any time by calling or texting 786-730-6332, including by replying STOP to our consent confirmation text. Revoking consent ends the child’s use of the online tools; it does not end in-person tutoring.
Security
We maintain a written information security program for children’s personal information: a named staff member coordinates it; we assess risks and review the program at least once a year; and we test and monitor our safeguards. Before a service provider collects, stores or receives a child’s personal information, we confirm it can protect it and obtain its written commitment to keep it confidential and secure.
Retention
This is our written retention policy for information collected online from a child (it is also part of Section B.6). We keep it only as long as reasonably necessary for the purpose it was collected for, never indefinitely, and then delete it securely. (1) Portal login, sign-in records (IP address, device and browser details) and anything the child entered or uploaded in the portal: kept so the child can sign in and use the portal and so the portal stays secure; deleted within thirty (30) days after the login is closed, whether on revocation of consent, on your request or when the relationship ends. (2) Tablet notes saved under the child’s name: kept so instruction can continue between sessions; deleted twelve (12) months after the child’s last session, or within thirty (30) days after you revoke consent or ask us to delete them, if sooner. (3) Audio recordings: kept so you can hear how a session was taught; deleted sixty (60) days after the session, or sooner on request, unless needed for a complaint or legal claim, and then kept only until it is resolved.
No tracking
No advertising, analytics or social-media tracking code runs on the portal pages, tablets or practice pages a child uses.
Practice platform
The online practice platform asks for its own parental consent at its own checkout under its Children’s Privacy Notice (practice.ututorsacademy.com/children-privacy). A child’s first name and exam reach the tutoring team only if you turn on sharing in that platform’s parent dashboard.
Teenagers
The Children’s Online Privacy Protection Act does not apply to Students aged 13 to 17. The parent remains the Client and may allow the Student a portal login. On the practice platform, a teenager may open a free-practice account with a parent’s email address under that platform’s terms.
